Welcome to FindWeekend (“we,” “us,” “our,” or the “Company”). These Terms of Service (“Terms,” “Agreement”) constitute a legally binding agreement between you (“user,” “customer,” or “you”) and FindWeekend governing your access to and use of our website located at https://findweekend.com (the “Site”), including all related services, features, content, applications, and functionality offered through the Site (collectively, the “Services”).

FindWeekend is a United States-based online retailer specializing in fine jewelry, including but not limited to rings, necklaces, bracelets, earrings, pendants, and related accessories (collectively, “Products”). By accessing our Site, browsing our collections, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately discontinue use of our Site and Services.

We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. Any changes will be effective immediately upon posting to the Site, with the revised effective date indicated at the top of this page. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates.

1. Eligibility and Account Registration

By using our Site, you represent and warrant that you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater. You must possess the legal authority to enter into binding contracts. If you are accessing or using the Site on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

To access certain features of our Site, including the ability to purchase jewelry items, save items to your wishlist, or track order history, you may be required to register for an account. When creating an account, you agree to provide accurate, current, and complete information as prompted by our registration forms, including your full legal name, valid email address, shipping address, and billing information. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately at support@findweekend.com of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account, refuse service, remove or edit content, or cancel orders at our sole discretion, including but not limited to instances where we suspect fraudulent activity, violation of these Terms, or any other activity that we deem harmful to our business interests or other users.

2. Product Information, Pricing, and Availability

We make every effort to display our jewelry products as accurately as possible, including detailed descriptions, high-resolution imagery, material specifications, dimensions, and care instructions. However, we do not guarantee that the colors, textures, finishes, or other visual representations of Products appearing on your monitor or device will exactly match the physical item, as display settings vary across devices. All Product descriptions, specifications, and pricing are subject to change at any time without prior notice.

All prices listed on our Site are in United States Dollars (USD) unless otherwise explicitly stated. Prices do not include applicable taxes, shipping fees, or customs duties, which will be calculated and displayed at checkout based on your shipping destination. For international orders shipped to Europe or other regions outside the United States, you are solely responsible for any import duties, customs fees, brokerage charges, or local taxes imposed by your country’s authorities. These charges are not included in the purchase price or shipping cost and are your financial responsibility.

Product availability is subject to change without notice. Due to the handcrafted or limited-edition nature of certain jewelry pieces, inventory levels may fluctuate rapidly. In the event that a Product becomes unavailable after you have placed an order but before fulfillment, we will notify you promptly via email at the address associated with your account. You will have the option to either wait for the item to be restocked, select a comparable alternative, or receive a full refund of the purchase price to your original payment method.

3. Orders, Payment, and Acceptance

By placing an order through our Site, you are making an offer to purchase the selected Product(s) subject to these Terms. All orders are subject to our acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to Product unavailability, errors in pricing or Product description, suspected fraudulent activity, or violations of these Terms.

We accept various forms of payment as indicated at checkout, which may include major credit cards (Visa, MasterCard, American Express, Discover), debit cards, PayPal, and other authorized payment processors. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including Product costs, applicable taxes, and shipping fees.

Your order constitutes a binding contract once we have processed your payment and sent you an order confirmation email. Please retain your order confirmation for your records. In the event that we are unable to process your payment, your order will be automatically cancelled, and we will notify you to provide an alternative payment method or to resubmit your order.

4. Shipping and Delivery

We ship jewelry orders to addresses within the United States, Canada, and select European countries as specified during checkout. All shipping and delivery timeframes are estimates and commence from the date of order confirmation, not the date of order placement. Processing times typically range from one (1) to three (3) business days, during which we carefully inspect, package, and prepare your jewelry for secure transit.

Given the valuable nature of jewelry items, all orders are shipped with insurance coverage and require an adult signature upon delivery. We strongly recommend shipping to a secure address where someone will be available to receive the package during business hours. FindWeekend is not responsible for lost, stolen, or damaged packages after delivery has been confirmed by the carrier’s tracking records. If you require special delivery instructions, such as holding the package at a carrier facility for pickup, please contact our customer service team at +1 6179843566 immediately after placing your order.

Risk of loss and title for Products purchased from our Site pass to you upon delivery to the carrier. You are responsible for filing any claims with the shipping carrier for lost or damaged packages. For international shipments, delivery times may be extended due to customs clearance procedures, which vary by country and are beyond our control.

5. Returns, Exchanges, and Refunds

We want you to be completely satisfied with your jewelry purchase. If for any reason you are not satisfied, you may return eligible Products within thirty (30) days of the delivery date for a full refund or exchange, subject to the following conditions and exclusions.

5.1 Return Eligibility

To be eligible for a return, the Product must be unused, unworn, undamaged, and in its original condition, including all original packaging, certificates of authenticity, appraisal documents, and any complimentary items that accompanied the purchase. Products that show signs of wear, alteration, resizing, engraving, or damage are not eligible for return. Customized, personalized, or made-to-order jewelry items, including engraved pieces and rings sized to your specific measurements, are final sale and cannot be returned or exchanged unless defective.

5.2 Return Process

To initiate a return, you must first contact our customer service team at support@findweekend.com or +1 6179843566 to obtain a Return Merchandise Authorization (RMA) number. Returns sent without an RMA number will not be accepted. You are responsible for the cost of return shipping and insurance, and we strongly recommend using a trackable shipping service with full insurance coverage, as we cannot guarantee receipt of your returned item. FindWeekend is not liable for returned items that are lost or damaged in transit to us.

5.3 Refunds

Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original payment method within seven (7) to fourteen (14) business days, depending on your payment provider’s processing times. Original shipping charges are non-refundable unless the return is due to our error (e.g., incorrect item shipped, defective Product).

6. Intellectual Property Rights

The Site and its entire contents, features, and functionality—including but not limited to all information, software, text, displays, images, video, audio, design, selection, arrangement, and look and feel of the Site, as well as all product photography, jewelry designs, logos, trademarks, service marks, and trade dress—are owned by FindWeekend, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows: (i) your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials; (ii) you may store files that are automatically cached by your Web browser for display enhancement purposes; and (iii) you may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

You must not delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Site. Any unauthorized use of the Site or its contents terminates the license granted by these Terms.

7. Prohibited Uses and Conduct

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates any applicable federal, state, local, or international law or regulation, including laws regarding the export of data or software to and from the United States or other countries.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate FindWeekend, a FindWeekend employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm FindWeekend or users of the Site or expose them to liability.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
• To use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.

8. Disclaimer of Warranties and Limitation of Liability

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY FindWeekend ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. FindWeekend MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

FindWeekend does not warrant that the Site, its servers, or email sent from FindWeekend are free of viruses or other harmful components. We do not warrant that the quality of any Products, services, information, or other material purchased or obtained by you through the Site will meet your expectations, or that any errors in the Site will be corrected. While we take great care in crafting and inspecting our jewelry, natural variations in gemstones, metals, and handcrafted items are inherent and do not constitute defects.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FindWeekend, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FindWeekend FOR THE SPECIFIC PRODUCT(S) THAT GAVE RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless FindWeekend, its parent company, subsidiaries, affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

10. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the State in which FindWeekend is headquartered, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal or state courts located in the jurisdiction of FindWeekend’s principal place of business. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Before initiating any formal legal proceedings, you agree to first contact us at support@findweekend.com to attempt to resolve the dispute informally. Both parties agree to negotiate in good faith for a period of at least thirty (30) days before resorting to arbitration or litigation. If the dispute cannot be resolved through informal negotiation, the parties agree that any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters related to intellectual property rights or unauthorized access to the Site.

11. Severability and Waiver

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of FindWeekend to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

12. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the sole and entire agreement between you and FindWeekend regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
